Guantanamo Bay facility is indee...Interesting blog. Guantanamo Bay facility is indeed part of USA 'territory'. I think the Supreme Court is currently scrutinizing whether the USA Constitutional Rights to a fair trial and Habeas Corpus applies to the Guantanamo detainees. Some judges are of the view that it does and others think opposite. <BR/><BR/>Anyhow, before we even get to the USA Constitution and who it applies to, there is precedental case law on this in the USA jurisprudence that gives fair trial rights to EVERYONE under USA criminal justice system.<BR/><BR/>My last blog deals with this.
